The General Terms and Conditions of Sale detailed below apply to all orders placed with Shopping for Happiness for all products and services offered on the Website.
Please read these Conditions carefully, our cookie policy and our Privacy Policy before using this website. By using this website or placing an order, you agree to be bound by these Conditions and by our Data Protection Policies.
Please make sure you have read and understood the Terms before placing your order.

These Conditions are subject to change. It is your responsibility to consult them regularly, because the applicable conditions will be those in force at the time of using this website.

Nevertheless, errors occurring during the update cannot held the liability of Shopping for happiness. Shopping for Happiness cannot be liable in case of an order cancellation because of stock depletion.
If the products are no longer in stock, we reserve the right to inform you about the possibility of ordering replacement products of identical value.
If you do not wish to order these replacement products, we will refund you for any amount paid.

5. Order

Acceptance of an order placed on the website are subject to compliance with the procedure put in place by Shopping for Happiness, expressed by a succession of different stages that the client shall follow in order to validate their order.

Client may at any time change or remove the products added in its bag. The bag summarizes the products selected by the client, as well as its price, and shipping costs, excluding customs and other taxes. Client may modify at any time its bag before validating the order.

The price paid by the client doesn’t include customs and others taxes. Such additional costs shall be directly paid by the client to the carrier.

6. Order refusal

We reserve the right to withdraw any product from this website at any time and to replace or modify any content or information on it. Although we always put everything in works to best respond to all orders, exceptional circumstances may arise such as a manufacturing or inventory issue or a payment incident, and require us to decline to process an order after sending you the Order Confirmation. We reserve this right at any time. In this case, if the payment has already been made, we will reimburse all amounts paid, including delivery costs as soon as possible, according to the same payment method as the one you used during the transaction. In any case, this reimburse will not incur any costs at your charge.

7. Delivery

Deliveries are carried out by our Local Post Service. We deliver from Monday to Saturday.
Delivery operates at the time of the transfer of the product’s physical possession to the client. The risk of lost or deterioration of the Product is transferred to the client at the time of the Delivery.

Delivery prices applicable to the order are those indicated on the website.
The delivery is made to the delivery address indicated by the client, being specified that it must be the address of the customer’s residence, an individual of their choice or a legal entity.

Client must make sure that they have provided accurate and complete information concerning the delivery address.
Orders are shipped within 7 business days at most for a Delivery in metropolitan France and 14 business days for an International Delivery, from the first business date after the confirmation of the order.

Delays may nevertheless occur in in the event of unforeseen circumstances or for the place of delivery.
If we are unable to meet the delivery date for any reason, we will notify you and offer to either continue the purchase process with a new date delivery, either cancel your order and refund you the full amount you have paid.

8. Prices and terms of payment

Price are mentioned in the websites in Euros. Prices are TTC but excluded delivery costs (which will be added to the total amount payable) and any customs duties and other taxes. Certain countries outside the European Union may be subject to additional charges (duties, taxes) upon reception depending upon the legislation of their country.

Shopping for Happiness reserves the right to modify its prices at any time but the products will be invoiced and paid on the basis of the rates in force at the time of placing the order, subject to availability.

The client expressly acknowledges that disclosure of their bank card number to Shopping for Happiness gives the company authorization to debit their account to the amount of the products ordered.

Errors may occur despite our best efforts to ensure that prices shown on the website are correct. If we detect an error in the price of the product (s) that you have ordered (s), we will inform you as soon as possible and offer you either confirm your order at the correct price, or cancel this order. If we don’t reach you contact, the order will be amounts paid.

By clicking on “Authorize payment”, you confirm that the credit card belongs to you.
Credit cards are subject to validity checks and authorization by the issuing body of these cards. If we do not receive the required payment authorization, we will not be held responsible for the delay or failure to deliver the products and we will not be able to enter into a Contract with you.

9. Withdrawal right’s duration and return conditions

According to article L.221- 18 of Consumer Code any non-professional customer could use its withdrawal right during a period of 14 days from the Delivery.

After such 14 days, the sale is final. The products shall be returned with its original packaging, with the original labels attached, brand new, without having used it or washed it.

Return of the product(s) is the responsibility of the customer and is at their own risk.

10. Refunds

A refund by Shopping for Happiness for the order returned is made within 14 days by the communication by the client of the withdrawal righs. The products must be in a perfect condition.

Repayment will be made through the same payment means used to pay the order. If the payment means is expired, the client shall contact the customer service to update the payment means. Shopping for Happiness cannot be liable if the repayment is made on an expired payment means.

11. Purchase of products as a guest

The site also offers you the opportunity to purchase products as a guest. Under this modality of purchase, you must only provide the data necessary to process your order.
At the end of the purchase process, you are invited to register as a user or to continue as un unregistered user.

12. Returns of defective products

We want to specify that the product “Le Coeur Brode” are all embroidered by hands, so hand work is different by automatic work and we hope you can understand this aspect. A hand work is unique so never can be the same of perfect. This aspect is valid also for all handmade items and for the vintage articles. Thank you in advance for your understanding!
If you believe that the product does not comply with the contract at the time of delivery, you must contact immediately using our e-mail address contact@shopping-for-happiness.com indicating the characteristics of the product in question and the nature of the defect.

We will refund or exchange the product as soon as possible and, in all the cases, within 14 days from the date on which we will have confirmed to you by mail you are entitled to a refund or an exchange of the product in question. If a defect or damage is found, the returned products will be subject to a full refund, including delivery costs you have paid. Return costs is in your charge. You cannot change or refund jewelry items.

13. Our liability

Nothing in these Terms shall exclude or limit Shopping for Happiness’s liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.
We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.
Shopping for Happiness is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.
Our maximum liability to you for any loss or damage arising in connection with your order shall be limited to the total price of your order.

14. Visible defects

In case of visible defect of a product, the customer shall send a demand to contact@shopping-for-happiness.com within 3 days from the delivery date. All demands shall mention the defect concerned. Failing that, the demand won’t be accepted and no return or exchange will be possible. The Product shall be returned, with its original packaging, with the original labels, brand new, without having used it or washed it at the address:

15. Colors

We make all reasonable efforts to accurately display the attributes of our products, including composition and colors. The color you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colors.

16. Guarantee

If there are defects in the goods you have purchased, Shopping for Happiness abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by returning the goods to us without delay by using the provided pre-printed return form.
The products we sell, especially items of a craft nature, often have characteristics specific to natural materials used in their manufacture. These characteristics may be subject to variations in fiber, texture, knots or color. These variations can in no case be considered as defects or damage. You must, at on the contrary, be aware of the existence of these variations and be able to appreciate them. We choose only the highest quality products, but the natural characteristics are inherent in our products and should be accepted as part of the intrinsic aspect of these last. The provisions of this clause will not affect your rights as consumer, or your right to terminate the Contract.

17. Assignment

Shopping for Happiness reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods.

18. Severance

If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.

19. Links on our website

If our website contains links to other sites and third party data, these links will be provided for informational purposes only, without our having any control over the content or the data from these sites. Consequently, we decline all responsibility in the event of loss or nuisance resulting from the use of these links.

20. Force Majeure

We will not be held responsible for any non-performance or any delay in the execution of our contractual obligations caused by events beyond our reasonable control, Force Majeure, as defined in article 1218 of the Civil Code and by case law.
It is understood, on the one hand, that our contractual obligations will be suspended as long as the case of Force Majeure and, on the other hand, that our lead times to meet these obligations will be extended for a period equivalent to that of the case of Force Majeure. We will strive in the possible to end the case of Force Majeure or to find a solution allowing us to fulfill our contractual obligations despite the case of Force Majeure.

22. Partial Invalidity
